Song of the Day #4,056: ‘Joyful Noise’ – Flame

A couple of weeks ago, a federal jury decided that Katy Perry copied the track ‘Joyful Noise’ by Christian rapper Flame when writing her hit ‘Dark Horse.’

The jury assessed damages of $2.78 million to be paid by Perry and ‘Dark Horse’s other songwriters.

Perry will certainly appeal, but the outcome of this lawsuit is scary for anybody who writes and records music for a living.

Flame’s lawyers offered no evidence that Perry had ever heard ‘Joyful Noise’ (she insists she hadn’t) and based their argument not on ‘Dark Horse’s melody or chord progressions, but on a simple sequence of four synthesized notes that plays underneath the song’s verses.

This video by musician and YouTuber Adam Neely goes into a lot of good detail about why this lawsuit is absurd, and essentially a case of a musicologist getting paid by lawyers to trick a jury with fancy technical jargon.

I don’t know much about songwriting, but my layman’s opinion after listening to both songs is that Perry shouldn’t have to pay one cent.

    Another great idea for a theme week.

    I can’t believe the jury found a copyright infringement here. Hopefully, this will be overturned on appeal.
